Terms of Service

Last updated: September 24, 2026

These Terms supersede all prior versions, including the waitlist terms dated April 28, 2026.

1. Agreement to these Terms

Welcome to SellMCM. These Terms of Service ("Terms") are a binding agreement between you and SellMCM LLC ("SellMCM," "we," "us," or "our"), governing your access to and use of the website at sellmcm.com and any related pages, features, submission forms, and services (together, the "Site"). By accessing or using the Site — including by joining the waitlist, submitting a piece of furniture, creating a seller or dealer account, submitting an offer, or subscribing — you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date, and — where you have given us your email address — we will make reasonable efforts to notify you by email of material changes, including any change to fees or to the dispute-resolution terms. Continued use after a change means you accept the revised Terms.

2. Eligibility

You must be at least 18 years old, located in the United States, and able to form a binding contract to use the Site. If you use the Site on behalf of a business, you represent that you are authorized to bind that business to these Terms.

3. What SellMCM is — and what it is not

SellMCM is a lead-capture and deal-routing platform operated by SellMCM LLC. We connect people who want to sell a piece of mid-century modern furniture with dealers who may want to buy it — starting with Modern Hill Furniture, an affiliated company that is the primary dealer on SellMCM. In practice:

  • How it works — two steps. You submit a piece. First, Modern Hill Furniture — the primary dealer on SellMCM — reviews it and may make you a direct, instant cash offer to buy it (Step 1). If Modern Hill does not buy your piece, we can then introduce you to other resellers in your area (Step 2), who make private ("blind") cash offers; you choose whether to accept one, and you and that dealer complete the sale directly. See §4.5 for both steps.
  • What SellMCM — the platform — is NOT. SellMCM is not a marketplace — the platform itself does not buy, consign, list, or sell furniture, and does not display pieces for buyers to browse. (Modern Hill Furniture, an affiliated company under common ownership with SellMCM LLC, participates as the primary dealer and may buy your piece directly — see the affiliate disclosure in §4.7.) SellMCM is not a payment processor — we never hold, transmit, or escrow money between a buyer and a seller; payment is handled directly between the two parties after introduction. SellMCM is not a shipping or logistics service — pickup, delivery, and transport are arranged between the buyer and the seller, and we do not coordinate, insure, or guarantee them.

The Site also includes:

  • Reference content — the pages at /ref/* (piece pages, designer and maker profiles, categories) and related editorial material about mid-century modern furniture, provided for informational and educational purposes only. These are not shopping pages.
  • Accounts and features — the waitlist, seller accounts, and (for dealers) the dealer network features described in §9.

We may add, change, suspend, or discontinue any part of the Site at any time.

4. Furniture submissions, offers, messaging, and your content

4.1 You keep ownership. When you submit photographs, descriptions, or other information about a piece ("Submission"), you keep all ownership and copyright in your Submission. You represent that you own or have the right to submit it, and that it does not infringe anyone else's rights.

4.2 The license you grant us (evaluation, identification, and dealer routing). You grant SellMCM a non-exclusive, worldwide, royalty-free license to use your Submission solely to: (a) evaluate the piece and communicate with you about it; (b) identify, describe, and authenticate the piece; and (c) share your Submission — your photographs plus the piece's general location (city/state) — with the dealers in our network whom we match to your piece, so they can make private cash offers. This license lasts as long as needed for those purposes.

We share your Submission only for that dealer-routing purpose and only with matched network dealers, who are bound by our Dealer Terms (§9) to keep it confidential, use it solely to evaluate and make an offer on your piece, and not copy, republish, resell, or otherwise reuse it. We do not sell or rent your Submission, we do not share it with any third party for their own marketing, and we do not publish your Submission on the public Site or any other public website. Your name and contact details are never shared with any dealer unless and until you accept that dealer's offer (see §4.6) — at routing, matched dealers see only your photographs and the piece's general location (city/state), never your name or address.

4.3 AI / machine-learning training — separate, opt-in only. We will not use your Submission to train, fine-tune, or develop any machine-learning or artificial-intelligence model unless you separately and expressly opt in by checking the clearly-labeled box provided for that purpose. This consent is distinct from the licenses in §4.2, is entirely optional, is off by default, and you may withdraw it from your submission page at any time (or by contacting us) (withdrawal applies going forward). We do not treat any general "improve our services" language as consent to model training.

4.4 People in photos. Please do not include images of identifiable people in a Submission. Before we share a Submission with any dealer, we review it; if it contains an identifiable person, we will exclude or obscure that image, or decline to route that image or the Submission. We do not use an image containing an identifiable person for evaluation, identification, dealer-sharing, or (if ever applicable under §4.3) training.

4.5 How submissions and offers work. Submitting a piece does not create any obligation — yours or ours — and is not a sale. Offers work in two steps:

  • Step 1 — Modern Hill first look and instant offer. Every submission is reviewed first by Modern Hill Furniture, the primary dealer on SellMCM (an affiliated company under common ownership with SellMCM LLC — see §4.7). If your piece qualifies, Modern Hill may make you a direct, immediate ("instant") cash offer — often same-day. Modern Hill's offer is not blind: you know the offer is from Modern Hill, and you deal with Modern Hill directly. If you accept Modern Hill's offer, the sale is between you and Modern Hill — Modern Hill is the buyer and reseller of record, and you negotiate and complete the sale directly with Modern Hill. Modern Hill may decline to make an offer for any reason and at its sole discretion.
  • Step 2 — Introduction to other resellers (only if Modern Hill does not buy). If Modern Hill does not make an offer on your piece, we introduce you to other resellers in your area who may want to buy it. By submitting your piece you ask us to do this if Modern Hill does not buy, so no separate step is required; we route your piece to matched network dealers, who make private offers. You may withdraw your piece at any time before you accept an offer. If instead Modern Hill makes you an offer and you decline it, SellMCM, in consultation with Modern Hill, decides whether to introduce your piece to other resellers; a piece Modern Hill has made an offer on is never automatically routed:
    • Blind offers. Each matched dealer submits a single private offer without seeing other dealers' offers. Dealers do not see your name or contact information (only your photographs and the piece's city/state), and you see each offer without the offering dealer's identity — a dealer's name and contact information are revealed to you only if and when you accept that dealer's offer (see §4.6). This is not an auction; there is no bidding, counter-offer, or negotiation through the Site.
    • Your choice, on a timer. You see all offers together and have 7 days to accept one; we may send a reminder before then. If you do not accept within 7 days, the offers expire. You can reactivate an expired submission.
  • Sellers pay nothing. Submitting a piece and receiving offers through SellMCM — whether a direct offer from Modern Hill or offers from network dealers — is free to sellers. We are paid by network dealers, never by you (see §9). This is how SellMCM works today and how we intend to keep it. We reserve the right to change the seller-side terms only prospectively and only with notice as described in §1; any such change would apply to future submissions, never retroactively to a piece you have already submitted, and we will never charge you a fee for a submission or offer made under the terms in effect when you submitted it.

4.6 If you accept an offer — contact exchange. When you accept a dealer's offer, we introduce you and that dealer to each other by sharing your contact information and the dealer's — name, email address, phone number, and the physical address needed to arrange pickup or delivery of the piece — with one another, so you can arrange and complete the sale directly. We share these details only with the one dealer whose offer you accept, and only at that point. No dealer receives your contact information or your address before you accept an offer, and dealers whose offers you do not accept never receive them at all. Our Privacy Policy (§8) describes this exchange; by accepting an offer you consent to it.

4.7 SellMCM is not a party to the sale. Any sale that results from an accepted offer is solely between you and the dealer. In its role as the platform that routes offers, SellMCM is not a buyer, seller, consignor, consignee, broker, or agent of either party, and does not take title to or possession of any piece. We do not handle, hold, transmit, or escrow payment, and we do not arrange, insure, or guarantee pickup, shipping, or delivery — those are arranged and completed directly between you and the dealer. We make no representation or warranty about any dealer, any buyer, any piece, any offer, or whether a sale will close, and we are not responsible for the conduct of either party or the outcome of any transaction.

Modern Hill's role — affiliate disclosure and conflict of interest. SellMCM is operated by SellMCM LLC. Modern Hill Furniture is an affiliated company, under common ownership with SellMCM LLC, and is the primary dealer on SellMCM. As described in §4.5, Modern Hill gets the first look at every submission and may make you a direct, instant offer to buy your piece itself. When Modern Hill buys your piece, the sale is between you and Modern Hill — Modern Hill is the buyer and reseller of record, and Modern Hill's obligations as buyer are its own. The "not a party to the sale" disclaimer above describes SellMCM's role as the platform, and does not disclaim Modern Hill's separate role when it acts as the buyer. Only if Modern Hill does not buy your piece do we introduce you to other, independent network dealers (§4.5, Step 2). We disclose that Modern Hill is affiliated with SellMCM LLC (common ownership) and acts as its primary dealer so that you can weigh Modern Hill's offer, and any later network offers, on their own terms. You are never obligated to accept any offer, and you remain free to sell your piece elsewhere.

4.8 Messaging — conduct and no pre-acceptance contact information. SellMCM may provide messaging so that a seller and a dealer can ask and answer questions about a submitted piece. In any message you send through the Service, you agree that you will not:

  • request, offer, or share direct contact or personal information — including a name, phone number, email address, mailing address, social-media handle, external URL, messaging-app ID, or payment details — before an offer has been accepted and SellMCM has introduced the parties (see §4.6);
  • solicit, arrange, or encourage the other party to complete or discuss the deal outside the Service before acceptance, or otherwise circumvent SellMCM's per-deal dealer fee;
  • as a dealer, attempt to identify yourself to a seller, or otherwise de-anonymize your identity or business, before your offer is accepted — this protects the integrity of SellMCM's blind-offer process;
  • send spam, unsolicited promotions, or solicitations unrelated to the submitted piece;
  • harass, threaten, abuse, or discriminate against any user, or use profanity or hate speech; or
  • contact a user after they have asked you to stop, or interfere with another user's dealings on the Service.

SellMCM facilitates the exchange of contact information automatically and only after an offer is accepted (§4.6). Sharing it earlier is unnecessary and prohibited. Completing the sale off-platform after an introduction is by design and is not prohibited — only pre-acceptance solicitation and fee circumvention are.

4.9 How SellMCM handles messages — monitoring, our role, and the blind-offer safeguard.

  • Monitoring. SellMCM may — but is not obligated to — monitor, filter, and review (by automated means, and by SellMCM personnel where a message is flagged) and store the messages you send and receive through the Service, in order to detect and prevent fraud, abuse, spam, disclosure of personal contact information, off-platform solicitation, and other violations of these Terms; to record non-personal facts about the items discussed (such as maker, date, materials, dimensions, and condition); and to operate, secure, support, and provide the Service and comply with law. We retain copies of communications for these purposes. Because SellMCM is a closed platform, every participant in a conversation is a registered account-holder who has agreed to these Terms, including this section; by using the messaging you consent, as to the messages you send and receive, to the monitoring, recording, and handling described here.
  • Our role — a participant in the messaging, and an AI concierge. Before an offer is accepted, messages between a seller and a network dealer are relayed through SellMCM (the network dealer's identity is hidden until acceptance), so SellMCM is a participant in those communications, not merely a passive conduit. To help both sides communicate, the Service may use automated and artificial-intelligence systems (a "SellMCM concierge") that read the messages in a conversation in order to relay them, suggest replies, prompt for details the other party is likely to want (such as dimensions, condition, or provenance), and flag a question that looks unanswered. Where SellMCM uses an outside provider for this, that provider is contractually bound not to retain the content and not to use it to train its own models. This assistance is part of how the messaging Service works; it is separate from the optional permission to improve our models in §4.10, and message content used for in-conversation assistance is not retained to train models unless you give that separate permission. We expect these features to evolve — early on a person may handle or review messages, then AI may draft reply options for our review, and over time AI may handle routine, frequently-asked questions about how SellMCM works directly while referring anything needing judgment to us. How we provide this is at our discretion and is offered on a beta basis (see §4.11). This role in the messaging does not change §4.7: SellMCM remains not a party to the sale and is not responsible for the transaction itself.
  • Protecting the blind-offer process. Until an offer is accepted, network dealers make offers without seeing your identity, and you do not see theirs. To protect this, SellMCM screens messages before delivering them on the anonymous dealer channel and will hold, redact, or block any message that would reveal a party's identity or contact information, or that solicits a deal outside the Service. Once an offer is accepted, SellMCM introduces the parties and you exchange details directly.

4.10 Using your messages to improve our AI — separate, opt-in only. We will not use the content of your messages to train, fine-tune, or develop any machine-learning or artificial-intelligence model unless you separately and expressly opt in by checking the clearly-labeled box provided for that purpose. Like the photo-training consent in §4.3, this permission is distinct from the operational uses above, is entirely optional, is off by default, and you may withdraw it at any time (withdrawal applies going forward and does not affect models already trained). We use a conversation to train our models only if every participant in that conversation has given this permission; if a participant has not, we may still record non-personal facts about the item — such as maker, date, materials, dimensions, and condition — but not that participant's message text. This permission also covers messages exchanged directly between buyer and seller after an offer is accepted, which we use only where (i) all participants in the conversation have opted in and (ii) all participants acknowledged SellMCM's continued presence in the conversation at acceptance, and only in de-identified, aggregate form to improve SellMCM's services (for example, understanding what helps a transaction succeed). We de-identify communications before any such use, we do not sell your personal information, and this permission is not required to use SellMCM or its messaging.

4.11 Messaging and AI features are in beta. SellMCM's messaging and any automated or AI-assisted features are new and still being developed and refined. (We do not use the content of your messages to train our models unless you separately opt in — see §4.10.) We provide them on a beta, early-access basis, "as is" and "as available," to the fullest extent permitted by law, without warranty of accuracy, availability, or uninterrupted operation. During this period we may, at our discretion, provide, limit, change, pause, or discontinue these features in whole or in part at any time and without prior notice. We may handle any conversation manually, with AI assistance, or automatically, and we do not promise that AI is used on — or that any particular reply is generated for — every message. Automated or AI-generated messages may be inaccurate or incomplete and are not a binding offer, appraisal, or commitment. The beta period continues until we make a feature generally available or discontinue it. Nothing in this section changes §4.7 (SellMCM is not a party to the sale).

5. Our content and intellectual property

5.1 Our materials are protected. Except for your Submissions, all content on the Site — including our reference photographs, editorial descriptions, and compiled value data, reference articles, the selection and arrangement of the /ref/* pages, page layout, logos, and the "SellMCM" and "Modern Hill" names and marks — is owned by or licensed to us and is protected by copyright, trademark, and other laws. Our in-house photography is our copyrighted work regardless of who owns the piece depicted.

5.2 Facts are free; our expression is not. Factual information — such as a designer's name, a production date, dimensions, or a model number — is not owned by anyone and you are free to use it. What you may not do is copy or reproduce our photographs, our written descriptions, our compiled reference sets, or the look and feel of the Site.

5.3 Limited permission. We grant you a limited, revocable, non-transferable license to view and use the Site for your own personal, non-commercial reference. Any other use — including reproduction, redistribution, or commercial use of our content — requires our prior written permission.

6. Acceptable use — no scraping, no AI harvesting

6.1 No automated access. Except for general-purpose search engines indexing this Site for public search results in compliance with our robots.txt, you may not use any robot, spider, scraper, crawler, plug-in, or other automated means to access, monitor, copy, or extract any content, images, value data, or other data from this Site without our prior written permission.

6.2 No AI / machine-learning use. Content on this Site — including reference photographs, descriptions, and compiled value data — may not be used to train, fine-tune, test, or validate any machine-learning or artificial-intelligence model or dataset without our prior written permission.

6.3 Text and data mining reservation. SellMCM expressly reserves all rights in the content of this Site for purposes of text and data mining under Article 4(3) of EU Directive 2019/790 and all analogous laws.

6.4 Other prohibited conduct. You also agree not to: interfere with or overload the Site or its infrastructure; attempt to gain unauthorized access to any account, system, or data; circumvent any access control, rate limit, or bot mitigation; misrepresent your identity or affiliation; submit false or fraudulent information or offers; or use the Site for any unlawful purpose.

7. Reference content — no warranty, not an appraisal

The reference content on the Site is provided "as is," for general information only. It is not an appraisal, authentication, valuation, or guarantee of any piece's origin, attribution, condition, or value, and it should not be relied on as professional advice. Furniture attribution is inherently uncertain; we make no representation that any reference entry is complete or error-free. Any value information shown is illustrative and is not an offer to buy or sell.

8. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains what personal information we collect and how we use it — including the contact exchange described in §4.6 (when you accept an offer, your contact details and the winning dealer's are shared with each other so you can complete the sale directly).

9. Dealer Terms (applies to network dealers)

These Dealer Terms govern the network dealers who are introduced to sellers in Step 2 of §4.5. (Modern Hill's own first-look purchases under Step 1 are direct purchases by Modern Hill acting as a buyer, and are not subject to the per-deal network fees in this section. When Modern Hill reviews a submission at first look, however, it is bound by the same confidentiality and no-reuse obligations as any network dealer under §9.7: it uses your Submission solely to evaluate the piece and decide whether to make an offer, and does not copy, republish, resell, retain for any other purpose, or otherwise reuse it. A submission that Modern Hill declines is not retained in, added to, or copied to Modern Hill's separate customer, mailing, marketing, or CRM systems.) If you register as a dealer, the following terms apply to you in addition to the rest of these Terms. SellMCM may also ask dealers to accept a separate Dealer Agreement; if there is a conflict, the signed Dealer Agreement controls.

9.1 What dealers get. Access to an opportunity feed of seller submissions matched to your declared operations zone, the ability to submit offers, and a dashboard to track pieces you acquire.

9.2 Blind offers. You submit one private offer per submission. You cannot see other dealers' offers, and there is no bidding, counter-offer, or negotiation through the Site. An offer you submit is a genuine, good-faith commitment to buy the piece at your offered price if the seller accepts. Offers are valid for 7 days; if the seller does not accept within that window, the offer expires.

9.3 Deal fees — your authorization to charge. By submitting an offer, you authorize SellMCM to charge the payment card you keep on file, immediately and without further notice, the applicable per-deal fee below if — and only if — the seller accepts your offer. No fee is charged unless and until your offer is accepted. Fees are exclusive of any applicable taxes, which are your responsibility. The per-deal fee is based on your accepted offer amount:

Accepted offer amountFree tierSubscriber tier
$500 or less$50$25
$500.01 – $1,000$100$50
Over $1,000$200$100

9.4 Subscription (optional). A dealer subscription is $49 per month and unlocks the reduced ("subscriber tier") deal fees above. It renews automatically each month until you cancel; cancellation stops future renewals and takes effect at the end of the then-current billing month. Subscription fees already paid are non-refundable except as required by law. You authorize SellMCM to charge your card on file the subscription fee each month until you cancel. You can cancel at any time, online from your dealer dashboard — using the same method by which you subscribed — or by contacting us. If you cancel, you keep subscriber-tier pricing through the end of the period you have paid for. If a renewal charge fails, subscriber-tier pricing is suspended until payment succeeds, and deal fees during that time are charged at the free-tier rates.

9.5 On acceptance. When a seller accepts your offer, the applicable deal fee is charged to your card on file, the other dealers are notified their offers were not selected, and you and the seller are introduced to each other (contact exchange, §4.6) so you can complete the purchase directly. The purchase, payment, and pickup/transport are solely between you and the seller — SellMCM is not a party to the sale, holds no money, and arranges no logistics (§4.7).

The deal fee is earned when the seller accepts your offer, because at that point SellMCM has delivered the service you paid for — matching your piece and introducing you to the seller. The fee is not contingent on the off-platform sale actually closing. If the sale later falls through, the fee is not refunded in cash; your only remedy is the discretionary deal-fee credit in §9.6 — a credit applied toward a future deal fee, never a cash payout — which we extend to seller non-performance (for example, a seller who becomes unreachable, has already sold the piece elsewhere, or declines to complete the sale at pickup).

9.6 Disputes — not-as-described and seller non-performance. If a piece is materially not as described when you complete the purchase, or if the seller fails to complete the sale (for example, becomes unreachable, has already sold the piece elsewhere, or declines to complete the sale at pickup), you may report it to SellMCM within 30 days from the time the seller accepted your offer. Our team reviews reported disputes and, at our discretion, may issue a credit toward a future deal fee — a credit only, never a cash refund — or deny the report. This is a manually mediated, good-faith courtesy process; it is not a guarantee, insurance, a cash refund of the deal fee or the sale price, or escrow, and it does not make SellMCM responsible for the piece, the seller, or the transaction (§4.7).

9.7 Dealer conduct. You agree to: make offers only within your declared operations zone; honor every offer you submit if it is accepted; keep seller Submissions confidential and use them solely to evaluate and make offers (no copying, republishing, reselling, or reuse — §4.2); and keep a valid payment method on file. We may suspend or remove any dealer who violates these Terms.

10. Disclaimers and third-party links

10.1 Third parties. The Site may link to third-party sites we do not control, and the Site introduces sellers and dealers who are generally independent third parties (except that Modern Hill Furniture, an affiliated company under common ownership with SellMCM LLC, may itself act as a dealer — see the affiliate disclosure in §4.7). We are not responsible for the content, products, practices, or conduct of any third party, and a link or an introduction is not an endorsement.

10.2 "As is." To the fullest extent permitted by law, the Site and all content are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.

11. Limitation of liability

To the fullest extent permitted by law, SellMCM LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Site or from any transaction, offer, or introduction facilitated through it. Our total liability to you for all damages, losses, and causes of action (whether in contract, tort including negligence, or otherwise) relating to the Site or these Terms will not exceed the amount you paid, if any, to access the Site (or, if you are a dealer, the total fees you paid us in the 12 months before the event giving rise to the claim).

12. Governing law and disputes

12.1 Governing law and venue. These Terms are governed by the laws of the State of Illinois, as applied to agreements entered into and performed entirely within Illinois, without regard to conflict-of-laws rules. The exclusive venue for any proceeding is the state and federal courts located in the County of Cook, State of Illinois.

12.2 Mediation, then binding arbitration. If a dispute arises under these Terms, you and we agree to first try to resolve it with a mutually agreed-upon mediator in the County of Cook, State of Illinois. If mediation does not resolve the dispute, we agree to submit it to binding arbitration in the County of Cook, State of Illinois, under the rules of the American Arbitration Association.

12.3 Class-action waiver. To the fullest extent permitted by law, you and we agree that any dispute will be resolved only on an individual basis, and that neither party may bring or participate in a class, collective, consolidated, or representative proceeding.

13. Indemnification

You agree to indemnify, defend, and hold harmless SellMCM LLC, Modern Hill Furniture, and their affiliates, officers, and employees from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your Submission or any content you provide, including any claim that it infringes or misappropriates a third party's copyright, trademark, privacy, publicity, or other rights; (b) your breach of these Terms; (c) your violation of any law or the rights of any third party; or (d) any transaction, offer, or dealing between you and another user. We may assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us.

14. Copyright and DMCA

We respect intellectual-property rights and expect our users to do the same. If you believe content on the Site — including a photograph shared with our dealer network — infringes your copyright, send a notice to our designated agent with the information required by the Digital Millennium Copyright Act (17 U.S.C. § 512): (1) your physical or electronic signature; (2) identification of the copyrighted work claimed to be infringed; (3) identification of the material claimed to be infringing and where it is located; (4) your contact information; (5) a statement that you have a good-faith belief the use is not authorized; and (6) a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act. We will remove or disable material as required and may terminate repeat infringers.

15. General

15.1 Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.

15.2 Entire agreement. These Terms, together with our Privacy Policy and any Dealer Agreement, are the entire agreement between you and us about the Site and supersede all prior agreements and understandings, including the waitlist terms dated April 28, 2026.

15.3 No waiver; assignment. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.

15.4 Electronic Communications. You consent to receive agreements, notices, and disclosures from us electronically, and you agree that electronic delivery to the email address associated with your account satisfies any legal requirement that such communications be in writing. You may withdraw this consent by closing your account.

16. Changes and termination

We may modify these Terms or the Site at any time. We may suspend or terminate your access if you violate these Terms. Sections that by their nature should survive termination — including §§4.1, 4.2, 4.3, 4.4, 4.6, 4.7, 4.8, 4.9, 4.10, 4.11, 5, 6, 7, 9 (including any accrued and unpaid deal fees, but not the ongoing authorization to charge under §§9.3–9.4), 10, 11, 12, 13, and 15 — survive.
